The Watson v. Fort Worth Bank & Trust was argued before the Supreme Court by former Tarrant County Democratic Chair, Art Brender, in 1988. Clara Watson, a Black employee at Fort Worth Bank & Trust challenged the bank after white applicants were chosen over her, four times for supervisory promotions. The bank relied on subjective judgments rather than formal standards, raising a critical question about how hidden bias operates. Art Brender argued that seemingly neutral, discretionary practices could still produce unlawful discrimination under Title VII. The Supreme Court agreed, reshaping workplace law and changing how employers nationwide evaluate promotions, hiring and other personnel decisions. Watson v. Fort Worth Bank & Trust has become one of the nation’s most frequently cited Supreme Court decisions, and is one of a handful of the most prominent employment-discrimination decisions... influencing far more than its original dispute.
