The Fifth Circuit Court of Appeals ruled that the FDA’s approval of mifepristone can stand -- but so can many of the restrictions Trump-appointed District Judge Matthew Kacsmaryk put into place last week that will significantly reduce access to this critical drug used in medication abortions and miscarriages, including making the mailing of mifepristone illegal.
The Department of Justice immediately sprung into action, appealing to the Supreme Court to step in and block the rest of Judge Kacsmaryk’s ruling too. Democrats in Congress filed an amicus brief with the court. Alexandria Ocasio-Cortez (N.Y.) and Republican Rep. Nancy Mace (S.C.) went a step further and called on the FDA to just ignore the ruling all together.
But where is Big PhRMA?
PhRMA, the pharmaceutical industry’s largest and biggest-spending lobbying association, continues to stand on the sidelines, re-issuing only a cut and paste statement from before the ruling was even announced that rather tepidly supports the Food and Drug Administration.
