The Comstock Act, a 150-year-old federal law, originally enacted to regulate "obscene," "immoral," and "lewd" material through the mail, has become a weapon in the ongoing struggle over reproductive rights in the United States.


It threatens to further undermine the hard-won victories of women's health advocates by ending the availability of safe, legal abortions in every single state nationwide. 


At the heart of the matter is a recent court case involving the Food and Drug Administration's (FDA) approval of mifepristone, a medication used for non-surgical abortions. Despite the FDA's recognition of mifepristone's safety and effectiveness, the Comstock Act's outdated provisions are being used in an attempt to outlaw the mailing of the medication entirely.


This battle is characteristic of a broader trend: the weaponization of antiquated legislation to remove women’s reproductive rights.


This is not an isolated incident or a regional phenomenon, but part of a systemic, national campaign by Republican extremists to ban abortion nationwide.
