Is Trader Joe’s next?

Earlier this year, Elon Musk’s SpaceX filed a legal brief attesting that the National Labor Relations Board, which protects the rights of workers to unionize, was unconstitutional. Both Trader Joe’s and Amazon quickly joined this specious legal argument.


Now, Musk has made a new, wild argument―and he got a federal appeals court to agree with him!


Elon Musk’s lawyers argued that he had a First Amendment right to engage in illegal threats against unionizing workers at Tesla factories. And the right-wing Fifth Circuit court ruled in his favor!!


It won’t be long before Trader Joe’s joins Elon Musk and comes for our union. We need to fight back!


Amazon has already joined Musk’s argument. Two of the richest men in the world are clearly prepared to take this thing all the way to the Supreme Court. And Trader Joe’s is likely to be along for the ride.


If the Supreme Court rules in Elon Musk’s favor that corporations have a First Amendment right to union bust, there will be no limits on the barrage of anti-union propaganda every worker will have to face, just to get a paycheck.


Courts have ruled repeatedly on the legality and constitutionality of the National Labor Relations Act. Elon’s argument is essentially asking the Supreme Court to change the law. If we can’t fight back, he could win!
